ARDraw Terms of Use (EULA)
These Terms of Use ("Terms") are a binding agreement between you and ERKOMOBİLE TEKNOLOJİ ANONİM ŞİRKETİ ("Erkomobile", "we", "us") regarding your use of the ARDraw mobile application and the website at ardraw.erkomobile.com (the "Service"). By downloading, installing or using ARDraw, you agree to these Terms. If you do not agree, do not use the Service.
1. License
Subject to your compliance with these Terms, Erkomobile grants you a limited, non-exclusive, non-transferable, revocable license to download and use ARDraw on Apple-branded devices that you own or control, solely for your personal, non-commercial use. This license is the standard Licensed Application End User License Agreement (EULA) between you and Erkomobile, and Apple Inc. is a third-party beneficiary of these Terms with the right to enforce them.
2. Subscriptions, free trials & billing
ARDraw offers the following auto-renewing subscription plans:
- Weekly — US$8.99 / week, with a 3-day free trial.
- Monthly — US$34.99 / month, with a 3-day free trial.
- Yearly — US$69.99 / year, with a 3-day free trial.
Prices in your local currency are shown at the point of purchase and may vary by region.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You may manage and cancel your subscription in your Apple ID account settings: Settings → [your name] → Subscriptions.
- If you cancel during the free trial, you will not be charged. If you cancel after the trial, your subscription will remain active until the end of the paid period.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- All purchases are final. Refunds are handled by Apple at reportaproblem.apple.com.
3. AI-generated content
ARDraw lets you generate line drawings from text prompts ("AI Output"). You agree not to submit prompts that:
- Are unlawful, harmful, abusive, harassing, defamatory, obscene, or sexually explicit.
- Depict or sexualize minors.
- Promote violence, self-harm, or discrimination.
- Infringe third-party intellectual property, privacy or publicity rights.
AI Output is generated programmatically and may not be unique to you. We do not guarantee the originality, accuracy or non-infringement of AI Output, and you are responsible for how you use it. Erkomobile may filter, refuse or remove prompts and Output that violate these Terms.
4. Community submissions
If you submit drawings to the community feature, you grant Erkomobile a worldwide, non-exclusive, royalty-free license to host, display, reproduce and distribute that submission within the Service. You represent that you own or have the necessary rights to your submission. We reserve the right to remove any submission at our discretion.
5. Acceptable use
You agree not to: (a) reverse engineer, decompile, or disassemble the app, except as permitted by law; (b) bypass any technical limitations or security features; (c) use the Service to develop a competing product; (d) use the Service in violation of any applicable law; (e) transmit malware or interfere with the Service.
6. Intellectual property
ARDraw, including all software, designs, illustrations, trademarks and documentation, is owned by Erkomobile or its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.
7. Third-party content & characters
The library may include drawings inspired by popular characters for educational tracing purposes. Any third-party trademarks or characters remain the property of their respective owners. Their inclusion does not imply endorsement.
8. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Erkomobile and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid to Erkomobile for the Service in the 12 months preceding the claim.
10. Apple-specific terms
- These Terms are between you and Erkomobile, not Apple. Erkomobile, not Apple, is solely responsible for ARDraw and its content.
- Apple has no obligation to furnish any maintenance or support services for ARDraw.
- In the event of any failure of ARDraw to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to ARDraw.
- Erkomobile, not Apple, is responsible for addressing any claims by you or any third party relating to ARDraw, including product liability claims, claims that ARDraw fails to conform to applicable legal requirements, and claims arising under consumer protection or similar law.
- Erkomobile, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party intellectual property infringement claim relating to ARDraw.
- You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your license ends and you must stop using the Service. Sections that by their nature should survive termination will survive.
12. Changes
We may update these Terms from time to time. Material changes will be communicated in-app or on this page. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. The courts and enforcement offices of Istanbul, Türkiye shall have exclusive jurisdiction over any dispute arising from these Terms, subject to mandatory consumer protection laws of your country of residence.
